"In 2011, the estate took legal action over a novel called Mirkwood: A Novel About JRR Tolkien, which used the author as a central character. The American author of the book, Stephen Hillard later went to a Texas district court to seeking a declaration that he had a right to publisher under the first amendment. The case was later settled when Hillard agreed to add the disclaimer: 'This is a work of fiction which is neither endorsed nor connected with The JRR Tolkien Estate or its publisher.'"

Own reflection : Since my fan fiction on Susan Pevensie (spanning by now about 70 - 80 chapters of my c. 7500 blogposts) features both C. S Lewis (if Susan Pevensie had been a real person, how could she not have met him) and Tolkien (responsible for one action in her favour and also for her sister Lucy's planned Catholic conversion prior to train accident), maybe they might like a similar disclaimer from me?
